In accordance with Article 4 of the Law on Implementation of the Spatial Plan of the Republic of Macedonia (“Official Gazette” no. 39/04), the Spatial Plan is implemented by developing and adopting Spatial Plans of Regions, Spatial Plans of Areas of Public Interest, Spatial Plans of Municipalities and the City of Skopje, as well as with Urban Plans for Settlements, Urban Plans for Areas and Buildings of Importance for the State and Urban Projects.
For the development and adoption of these plans, the Ministry of Environment and Spatial Planning issues a Decree for spatial planning conditions, based on a prepared document on the current spatial aspects required for the pre-planning process. Spatial planning conditions cannot be provided while the same Spatial Plan of the Republic of Macedonia is in force, based on which spatial planning conditions have already been issued for the same planning scope and the same purpose of the site.
The Spatial Planning Condtions contain general and special provisions, directions and solutions contained in a higher level planning documentation (the Spatial Plan of the State and the Plans for its elaboration and implementation) and a graphic attachment which is an excerpt from the Plan.
The request for obtaining a Decree for spatial planning conditions, is filed by the administrative body responsible for the procedure of development and adoption of the Urban Plan. The request is accompanied by:
- Proposed planning program,
- Copy of previously issued Spatial Planning Conditions for the relevant or adjacent planning scope, if any.
The Document on Spatial Planning Conditions is issued within 15 working days from the date of the receipt of the request.
The costs for preparing the document are paid by the applicant.
During the development of Urban Plans financed from the Budget of the Republic of North Macedonia, the Document on Spatial Planning Conditions is prepared ex officio, and the costs for its development are refunded from the Budget of Republic of North Macedonia, through the Annual Programs for Development of Urban Plans.
